PFAS Due Diligence Part 1: ESA Scoping Strategies

PFAS is included in the E 1527-21 Phase I ESA standard as a non-scope emerging contaminant and EPA has published a proposed rule to list the PFAS family of chemicals as hazardous substances under CERCLA. Based on feedback from our recent benchmark survey, the industry is split on how and when to integrate PFAS into the scope of ESAs.

The panelists will highlight crucial technical and legal issues, including:

  • If PFAS are “everywhere,” should we always include it?
  • Should we limit PFAS consideration to only known contaminated sites?
  • What do we do with the “potential impact” sites?
  • How do current regulations and future enforcement impact scoping?
  • What are the most important scoping factors to discuss with clients?
  • What if a client doesn’t want to include PFAS in the scope?

Kitchen, Jon
Mr. Kitchen has 24 years of experience as an environmental professional. He has conducted a variety of Phase I and Phase II Environmental Site Assessments (ESAs), and subsurface investigations throughout the Northeast United States. He has substantial experience with managing remedial investigation at large complex sites with numerous areas of concern. These sites include brownfields sites where he assisted with redevelopment activities, including negotiation support for covenants not to sue, administrative consent orders, and insurance issues. Mr. Kitchen has managed projects under all phases of the Massachusetts Contingency Plan (MCP). He has managed numerous in-situ chemical oxidation (ISCO) remediation projects. He has also managed numerous compliance projects including; SPCC Plans, SWPPPs, and industrial air permitting. As a part business owner of his former firm, Mr. Kitchen managed the commercialization of an innovative technology both from a business development and an implementation standpoint.
