Ohio MS4 Permit Update: Public Comments Due August 4

Ohio communities have until August 4, 2026, to review and submit comments on the Ohio EPA’s draft Small MS4 General Permit (OHQ000005). Released for public notice on June 4, 2026, the draft permit represents the next generation of requirements for municipalities covered under Ohio’s Municipal Separate Storm Sewer System (MS4) program.

For local governments, stormwater managers, permitees and partner organizations, the public comment period provides an important opportunity to understand proposed changes, evaluate how those changes may affect existing programs, and provide feedback before the permit is finalized.

Why the MS4 Permit Matters 

The National Pollutant Discharge Elimination System (NPDES) MS4 permit program plays a critical role in protecting water quality across Ohio. Through the program, municipalities implement stormwater management practices designed to reduce pollutants in runoff, protect streams and waterways, and meet state and federal regulatory requirements. 

Because the permit establishes the framework for municipal stormwater programs, updates can influence everything from program documentation and training to infrastructure mapping and illicit discharge investigations. 

Now Is the Time to Evaluate Existing Programs 

While the permit is still in draft form, municipalities can use this review period to assess current program strengths, and identify potential areas for improvement, the cost of implementation, and staffing impacts associated with the draft permit before the permit is finalized and the next permit cycle begins. 

Questions communities may want to consider include: 

  • Is the current Stormwater Management Plan up to date and reflective of existing operations? 
  • Are employee training programs adequately addressing pollutant prevention and stormwater compliance responsibilities? 
  • Is stormwater infrastructure mapping complete and current? 
  • Are illicit discharge detection and elimination procedures well documented? 
  • Are municipal facilities operating under effective Storm Water Pollution Prevention Plans? 

Taking inventory of these program elements now can help communities better understand how proposed permit changes may affect future compliance efforts. 

Assessing and Understanding Permit Changes 

Assessing and understanding permit changes is an important step in keeping an MS4 program aligned with regulatory requirements. Permit modifications can affect multiple areas of your MS4 program, so it is important to identify changes early and evaluate their potential impacts. By reviewing permit updates carefully, project teams can make informed decisions, avoid delays, and maintain clear communication with stakeholders throughout the process. 

Stormwater Management Plans 

Stormwater Management Plans serve as the foundation of an MS4 program. Regular updates help ensure that goals, procedures, and documentation remain aligned with regulatory requirements and municipal operations. 

Employee Training 

Municipal employees often serve on the front lines of stormwater protection. Training programs focused on pollutant identification, prevention practices, and permit requirements can help reinforce consistent compliance across departments. 

Municipal Facilities and SWPPPs 

Storm Water Pollution Prevention Plans (SWPPPs) help municipalities manage activities at maintenance facilities, public works yards, and other sites where stormwater impacts may occur. Periodic reviews and employee training are important components of successful implementation. 

Illicit Discharge Detection and Elimination 

Identifying and eliminating unauthorized discharges remains a cornerstone of the MS4 program. Dry-weather outfall screening, investigations, reporting, and documentation help communities protect receiving waters and maintain compliance. 

Mapping and Asset Management 

Accurate stormwater infrastructure mapping supports both regulatory compliance and long-term system management. GIS-based mapping and asset databases can improve tracking, inspection planning, and recordkeeping. 

Wetland Considerations 

For municipalities undertaking infrastructure or development projects, wetland delineation and mitigation requirements may also be an important consideration during project planning and permitting. 

Looking Ahead 

 The release of draft permit OHQ000005 marks an important milestone for Ohio’s stormwater community. While the final permit may change based on stakeholder feedback, the current comment period provides a valuable opportunity for municipalities to review the proposal, evaluate their existing programs, and prepare for the future. 

With the August 4 comment deadline approaching, communities that begin reviewing the draft permit now will be better positioned to understand potential impacts and plan for the next phase of MS4 compliance.
